Order & Delivery Policy

If you require the order to be delivered within the next 72 hours, please call 0429 824 646 before you place your order. If you cannot reach us instantly, place the order and if we cannot process your order within the next 72 hours, you will be fully refunded and notified ASAP.

Hot Canapés are not delivered hot.

These freshly cooked items are sent to you refrigerated and they just need to be warmed in your oven before serving. Only 8-12 minutes at 180 degrees or until hot to touch.

Privacy Policy

We do not share any personal information with any 3rd party companies. All orders are delivered by in-house staff.

Instant Catering Terms and Conditions

1. DEFINITIONS

In these Terms:

ACL means the Australian Consumer Law Schedule of the Competition and Consumer Act 2010 (Cth) and its associated Regulations, as amended;
Agreement means any agreement for the provision of Food and Services by Instant Catering to you;
Deposit means the amount payable by you in accordance with Clause 4;
Event means the event the subject of the Agreement;
Final Payment means an amount owed by you to Instant Catering, comprising the amount of your Quote / Tax Invoice plus any Transport Fee, less any Deposit paid;
Food means any food or beverages, and any items used to serve them such as cutlery, crockery and glassware, and includes equivalent substitutes where necessary as determined by Instant Catering;
Instant Catering means Going Gourmet Pty. Ltd. trading as Instant Catering;
GST means the Goods and Services Tax as defined in A New Tax System (Goods and Services Tax) Act 1999 (Cth) and its associated Regulations, as amended;
Insurance means Public Liability (with $20,000,000 limit) and Products Liability (with $20,000,000 limit);
Power means, as appropriate, electricity and/or gas as required;
Public Holiday means a date that is recognised as a public holiday in the State or territory in which the Event is taking place;
Services means the services supplied by Instant Catering pursuant to these Terms;
Terms means these Terms and Conditions; and
Transport Fee means the fee payable to Instant Catering under Clause 10.

2. GENERAL

Instant Catering is committed to ensuring your Event is successful and enjoyable.  By agreeing to this document, or by requesting provision of Food and / or Services from Instant Catering without agreeing to this document in the checkout process, you form an Agreement with Instant Catering and agree to be bound by all of the Terms.  If you have any queries regarding these Terms, please contact Instant Catering's events / management team.

3. QUOTATION &/or E-commerce ordering online

Instant Catering will provide you with a quotation or total amount due which, if accepted, is also a Tax Invoice (Quote).  Unless otherwise agreed in writing, the prices listed in the Quote are inclusive of GST, and these Terms apply exclusively to every Quote and cannot be varied or replaced. 

4. DEPOSIT

To secure your Event date, Instant Catering requires a deposit to the sum of 100% of your current Quote (Deposit). Until Instant Catering receives remittance of your Deposit amount, your date will not be secure.  You will receive an email with written confirmation of your Event and date once the monies have been received.  Payments for manual orders can be made via EFT or Credit Card and e-commerce transactions can only made via Credit Card. (Visa & MasterCard only)

5. EVENT CHANGES AND CANCELLATION

Due to some unforeseen circumstances, you may wish to cancel or change your Event date.  Any request to cancel or change an Event date must be made in writing via email to sales@instantcatering.com.au. Instant Catering is not liable for any loss or damage you may suffer by reason of requested changes or cancellation.

Cancellation – Where you cancel an Event date, and a future available date offered by Instant Catering is not viable, Instant Catering will deal with payments you have made as follows:

Instant Catering retains 100% of the Final Payment (if already paid by you), and deals with the Deposit as above in this table

Subject to Clause 19, in the unlikely event Instant Catering is unable to provide the Food or Services, it may cancel the Event under this Agreement.  If it does so, Instant Catering must return to you any and all monies you have paid to it, but otherwise to the maximum extent permitted at law is not liable to you for any loss or damage suffered.

Change – Instant Catering will do its best to accommodate a request for a change to your Event date.  However, Instant Catering can only accommodate changes of dates subject to availability, and as follows:
Request for change in date, made at least 90 days prior to original Event date: Instant Catering will accept a change to an available alternate date
Request for change in date, made less than 90 days prior to original Event date: Instant Catering will accept a change to an available alternate date that is within 30 days of your original Event date, failing which the Event is cancelled and Instant Catering retains the Deposit in full.

Please note that in the case of a change to your Event date, your Deposit will not be refunded but will instead be applied to secure your new date.

6. COOKING FACILITIES ON SITE (for staffed Events)

It is your responsibility to provide Instant Catering with as much detail as possible in regards to the cooking facilities on site for your Event.  You must provide photos of the space / area to setup, so Instant Catering's Chef(s) are fully prepared to cook and serve on the day.  If your Event will have access to a kitchen, Instant Catering requires that you provide photos, together with sufficient details as to ovens, stove tops, power access and proximity of the kitchen to where your guests will be so as to allow Instant Catering to adequately plan. 
If your Event is taking place on a rural property / venue which does not have a kitchen, it will be necessary for Instant Catering to set up a makeshift kitchen which may consist of ovens, BBQs, deep fryers, trestles and cooking marquees.  Each Event is unique, so these are quoted accordingly in the Quote.

7. ACCESS TO POWER (for staffed Events)

It is your responsibility to provide Instant Catering with access to adequate Power to run all required cooking equipment. Instant Catering will not be held responsible if food quality or service times are compromised due to Power supply not being sufficient to run its equipment, or Power interruptions.

8. UNACCEPTABLE RISK OR HAZARD (for staffed Events)

It is your responsibility to ensure the environment in which Instant Catering is requested to provide the Food and the Services is safe and free from hazard.  If in Instant Catering's opinion, exercised reasonably, it considers an environment in which it is requested to provide the Food and the Services represents an unacceptable danger or risk to the safety of its staff, Instant Catering may refuse to provide the Food and the Services, and will not be liability for any loss or damage you may sustain as a result of such refusal. 

9. RUBBISH DISPOSAL (for staffed Events)

Bar staff – If you have hired a bar staff (not a beverage package) you will be responsible for disposing of the rubbish created in the course of delivery of that Service. Instant Catering staff will neatly store filled rubbish bags in required / designated area, but will not remove rubbish from Event location.
Beverage package – If the Services you have purchased include a beverage package alongside Instant Catering's catering services, Instant Catering will remove all rubbish created by bar service and catering, inclusive of food scraps, disposables, empty bottles, etc.
Catering  Instant Catering will remove all rubbish caused by its Services related to catering / food service. Instant Catering will neatly store, and then remove, food scraps and any disposables the chef provides for your menu.

10. TRANSPORT FEE

Instant Catering will charge you a Transport Fee, calculated with reference to the amount of time spent travelling to and from your Event, the amount of staff required for your Event, relevant arrival and departure times, and the amount of equipment Instant Catering is required to transport.  Please advise us of any directional needs, unmarked roads or any unmade roads.
This Transport Fee is calculated and charged in accordance with the final, confirmed details provided by you in accordance with Clause 6, and is payable in accordance with Clause 16.

11. PARKING AT EVENT (for staffed Events)

Instant Catering staff assigned to your Event require access to park at the front of your venue (or as close as possible) to at the very least unload the vehicles being used by Instant Catering to transport equipment, food and beverages. Specifically, you must ensure a clearance of 2.2 metres is available for use by Instant Catering, having regard to the size of its vehicles and equipment.  To assist, please notify Instant Catering of loading zones, best parking or similar details when confirming information in accordance with Clauses 6.  You must reimburse Instant Catering for any parking charges that apply and that are paid by Instant Catering in relation to providing its Services at your Event.

12. INSURANCE

Instant Catering holds the Insurance.  It is your responsibility to take out any insurance beyond the Insurance that you consider necessary or desirable.

13. LIABILITY

Except as these Terms specifically state, the Agreement does not include by implication any other term, condition or warranty in respect of the quality, acceptability, fitness for purpose, condition or description of the Food or Services or any contractual remedy for their failure.  However, if you are a consumer within the meaning of the ACL, nothing in these Terms restricts, limits, or modifies your rights or remedies against Instant Catering for a failure of a statutory guarantee under the ACL. 
Instant Catering is not liable for any indirect or consequential losses or expenses suffered by you or any third party, howsoever caused, except to the extent of any liability imposed by the ACL.  Nothing in these Terms is to be interpreted as excluding, restricting or modifying the application of any State or Federal legislation applicable to the sale of goods or services that cannot be excluded, restricted or modified.

14. ALLERGENS

Instant Catering accepts no liability or responsibility for loss, damage, injury or illness of any kind whatsoever arising from any failure to comply with any dietary requirements that are not communicated to Instant Catering in accordance with these Terms.  Further, Instant Catering supplies its Food and Services to you subject to any express disclaimers as to the presence or potential presence of allergens.  

15. PUBLIC HOLIDAYS (for staffed Events)

If you book your Event to be held on a Public Holiday, labour costs associated with your event will be quoted/charged accordingly by an increase of 50%. The only services relevant to this increased charge are;

(a)          Wait staff or bar staff shifts (hourly rates)

(b)          Transport costs (staff time component only)

16. FINAL PAYMENT (for staffed Events)

Subject to this clause, the Final Payment is due and payable as a debt due to Instant Catering, and must be paid to Instant Catering in full no later than 7 days prior to the Event date. 

If you cancel the Event 8 to 29 days (inclusive) prior to the Event date, you remain liable to Instant Catering in the amount of 50% of the Final Payment (Liability), and must pay the Liability to Instant Catering immediately upon cancellation.  If you cancel the Event 30 or more days prior to the Event date, you are not required to pay any part of the Final Payment. 

17. PAYMENT DEFAULT

If you fail to comply with the requirements of Clause 16, then without prejudice to any of its other rights Instant Catering may do any or all of the following:

(a)          cancel your Event at your expense, upon providing written notice to you;

(b)          cease or suspend supply of any further Services under this Agreement to you;

(c)          charge you interest on the outstanding sum at the prevailing rate pursuant to the Penalty Interest Rates Act 1983 (Vic) plus 2 per cent for the period from the due date until the date of payment in full; or

(d)          charge you for, and you must indemnify Instant Catering from, all costs and expenses (including without limitation all legal costs and expenses) incurred by it resulting from the default or in taking action to enforce compliance with these Terms.

18. GOVERNING LAW

The law of Victoria from time to time governs these Terms.  You agree to the non-exclusive jurisdiction of the courts of Victoria, the Federal Court of Australia, and of courts entitled to hear appeals from those courts.

19. FORCE MAJEURE

Save for any obligation on your part to pay any sum owing to Instant Catering, neither Instant Catering nor you will be liable in any way arising howsoever to the extent that they are prevented from acting by events beyond their reasonable control including, without limitation, industrial disputes, strikes, lockouts, accident, breakdown, import or export restrictions, acts of God, or acts or threats of terrorism or war.
